Council Refuse Permission for Dwelling with Stables in Goatstown, Naas, Co. Kildare

Kildare County Council has refused permission for the construction of two storey dwelling house,10 number stables, tackroom, dungstead, horse walker, private well, effluent holding tank, secondary effluent treatment system, percolation area, all ancillary works and services at Goatstown, Naas Co.Kildare.   There were two reasons for refusal as follows:

 1.  It is the policy of the County Development Plan 2005 – 2011, namely policies RH 1 and RH 2, to focus the provision of one  -off rural housing in the rural countryside to the category of ‘local need’, subject to compliance with normal planning criteria including siting and design considerations. Based on the information submitted with the application, it is considered that the applicant does not comply with any of the Categories 1-5, outlined in Schedule 6.1 of the County Development Plan and as a result the proposed development would materially contravene objective no 6.6.1(2) of the Kildare County Development Plan 2005-2011 (which seeks to focus such developments to certain categories of applicants) and would also be contrary to the proper planning and sustainable development of the area.

 2.The policies contained within the Regional Planning Guidelines (RPGs) for the Greater Dublin Area 2004 – 2016 propose that development in the Hinterland planning policy zone be “strongly directed” into development centres and that development outside these areas should be limited to that required to meet local need. It is considered that the applicant has not demonstrated compliance with the rural housing policy of Kildare County Counciland accordingly the proposed development would contravene these policies and would therefore be contrary to the proper planning and sustainable development of the area.
