An Bord Pleanalal Refuse Permission for 32 sites in Clane, Co. Kildare

An Bord Pleanala have refused permission for site layout and development works for sixteen serviced sites and outline planning permission for the construction of 16 number two-storey detached dwellings with individual domestic garages on the aforementioned sites and all ancillary site works at Ballinagappa Road, Clane, County Kildare.  The sole reason for refusal related to the Osberstown WWTP capacity issue.

Permission for large-scale housing development refused in Newbridge, Co. Kildare

An Bord Pleanala has upheld the decision of Kildare County Council to refuse planning permission for 281 dwellings in Rickardstown, Newbridge, Co. Kildare.  Similar to the Board’s refusals for residential development in the Naas/Newbridge area over the past while the reasons for refusal related to the deficency in foul infrastructure (Osberstown).

Osberstown WWTP Upgrade Receives Funding

The Minister for the Environment has announced that the Osberstown Waste Water Treatment Plant upgrade and Lower Liffey Valley Waste Water Treatment Plant Upgrade have been included in the schemes to start construction under the Water Services Investment Programme 2010-2012. ‘€22m has been allocated for the Osberstown Waste Water Treatment Plant and €17.5m has been allocated to for the Lower Liffey Valley Waste Water Treatment Plant Upgrade

Kildare County Council Refuse Permission for Mixed-Use Development in Clane

James Browne was refused permision for demolition of existing bungalow and construction of new mixed use development comprising of 10no. apartments (7no. 1 bed apartments and 3no. 2 bed apartments) 8no. retail/commercial units (comprising a total of 760 sqm) etc on Main Street, Clane, Co. Kildare.  The reasons for refusal related were:

1. (a) Proposed development would be premature pending the upgrading of Osberstown WWTP and the sewer network in the Clane catchment.

 (b) Proposed development would be premature pending the upgrading of existing 225mm diameter foul sewer to 300mm diameter because the existing sewer is surcharging and has no capacity to cater for flows generated from proposed development in addition to existing development.

 (c) Existing 300 Surface water system has no capacity to cater for flows generated from proposed development in addition to existing flows.

d) Proposal submitted for surface water attenuation did not take into account 1:100 year flood. No design calculation submitted for surface water attenuation.

 The proposed development as currently proposed, therefore, would be prejudicial to public health and contrary to the proper planning and sustainable development of the area.

 2. The proposed development by reason of its scale, design and location, would constitute disorderly development, would be out of character with the pattern of development in the area, would seriously injure the amenities of the area and of property in the vicinity and would, therefore, be contrary to the proper planning and development of the area.

 3. The proposed development, by reason of its proximity to adjoining dwellings, would seriously injure the amenities of these dwellings through overlooking and consequent loss of privacy and would, therefore, be contrary to the proper planning and sustainable development of the area.

An Bord Pleanala refuses permission to construct 220 dwellings in Jigginstown, Naas, Co. Kildare

An Bord Pleanala has upheld the decision of Naas Town Council to refuse permission to Albany Homes Ltd for 220 dwellings, creche and retail unit in Jigginstown, Naas, Co. Kildare. The Board refused permission on the basis that the proposed development would be premature by reference to the existing deficiencies in the provision of sewerage facilities and the period within which this constraint may reasonably be expected to cease.  Two of the 3 reasons for refusal given by the Town Council has also related to inadequate services. This decision is consistent with the reason for refusal of other residential applications in Naas pending the upgrade of Osberston WWTP.

An Bord Pleanala Refuse Permission for 269 dwellings at Great Connell Road, Newbridge, Co. Kildare

An Bord Pleanala refused permission to Pat McGinn and Bernard Ross for 269 dwellings at Great Connell Road, Newbridge, Co. Kildare on the basis that the proposed development would be premature by reference to the existing deficiencies in the provision of sewerage facilities and the period within which this constraint may reasonably be expected to cease and would be prejudicial to public health.  Kildare County Council’s decision to grant permission for the proposed development (subject to 69 conditions) was appealed by Mr. Desmond Buckley of Great Connell Stud.

The deficiency is the provision of sewerage facilities (Osberstown) is continuing to be a major obstacle to development in Naas/Newbridge.

Planning Permission Refused for Large-scale Residential Development in Rickardstown, Newbridge, Co. Kildare

Kildare County Council have refused permission for a large-scale residentail development in Rickardstown, Newbridge, Co. Kildare.  Ted Nugent, John Nugent & Declan Gardiner had sought permission for 281 no. residential units with a mixture of semi-detached and terrace housing. There were two reasons for refusal; the first related to the lack of capacity in the Osberstown WWTP and the second related to prematurity pending the construction and commissioning of the proposed foul sewer network from the site boundary to Osberstown Waste Water Treatment Plant and the Newbridge East Sewer interceptor.
